Terms & Conditions
The terms on which AAD Logistics sells and delivers shipping containers, container garages, storage containers and portable buildings across Australia.
1. About these terms
These Terms and Conditions govern every quote, order, sale and delivery made by AAD Logistics PTY through https://aadlogisitcsau.com, by email or by phone. In these terms, “AAD Logistics”, “we”, “us” and “our” mean AAD Logistics Pty Ltd (ABN 95 667 760 607, ACN 667 760 607), trading as AAD Logistics PTY, operating from 4 Milton Cct, Port Macquarie NSW 2444, Australia. “You” and “customer” mean the person or business placing an order with us.
By requesting a quote, placing an order or paying an invoice, you accept these terms. Our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy, Warranty Policy, Payment Policy and GST & Tax Information form part of these terms. If a policy conflicts with these terms, these terms prevail, except where the policy gives you a greater right.
Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.
2. Who we are and what we sell
AAD Logistics sells new and used shipping containers, container garages, storage containers, portable offices, portable cabins, ablution and toilet blocks and crib rooms. We deliver Australia-wide from our Port Macquarie depot and through our carrier network. Our team brings more than a decade of container and logistics experience to every order.
Product listings describe each unit’s condition grade, size and configuration. Our Product Condition Guide explains what each grade means. Used units are sold in the condition described in the listing and the order confirmation.
3. Quotes
You may request a quote through our Request a Quote page, by email or by phone. A written quote is valid for 14 days from its issue date unless the quote states a different period. After that date, pricing, availability and delivery charges may change and a fresh quote is required.
A quote is an invitation to order, not a reservation of stock. Stock is allocated only after we confirm your order and receive cleared payment. Quotes for remote, restricted-access, oversize or multi-unit deliveries include delivery charges that are specific to the address and access conditions you have described. If those conditions change, the delivery charge may change.
4. Ordering and acceptance
You can order online through the website checkout or by accepting a written quote. When you submit an order we send an order confirmation and a tax invoice. The order confirmation is our acceptance of your order and forms a binding contract on these terms.
We may decline or cancel an order before dispatch where stock is unavailable, where a pricing or listing error has occurred, where payment cannot be verified, where the delivery address falls outside our standard service area and no quote has been agreed, or where we reasonably suspect fraud. If we cancel an order you have already paid for, we refund the full amount paid.
You are responsible for checking that the product, condition grade, quantity, delivery address and site contact on the order confirmation are correct. Tell us promptly if anything needs correcting.
5. Pricing and GST
All prices on the website are in Australian dollars and include 10% Goods and Services Tax unless a page clearly says otherwise. The total shown at checkout is the amount payable, including the delivery charge where the address is within our standard service area.
We may change listed prices at any time. Price changes do not affect an order we have already confirmed. Where a listed price is obviously wrong, we may contact you before acceptance to correct the price or cancel the order. See our GST & Tax Information page for tax invoices and GST treatment reviews.
6. Payment
We accept payment by bank transfer (direct deposit), or by credit or debit card through a secure payment link on the tax invoice we email after reviewing your order. No card details are entered at checkout, and we never take card details by email or phone. Banking details are provided in the order confirmation and by our sales team. We never publish banking details on public pages.
Payment is due in full against the order confirmation and tax invoice before your unit is prepared for delivery, unless a deposit arrangement is stated on the quotation for a custom or modified order. Uploading a remittance advice does not confirm payment. We prepare your unit only after our accounting team confirms that cleared funds have been received or that your card payment has been completed.
Orders that remain unpaid 7 days after the order confirmation may be cancelled and the allocated stock released. Our Payment Policy explains the payment process and how to protect yourself from fraudulent payment-instruction emails.
7. Title and risk
Title to a product passes to you when we receive full payment of the total price, including delivery charges and any agreed variations. Until title passes, the product remains our property and you must not sell, encumber or dispose of it.
Risk in the product passes to you on delivery, meaning the moment the unit is unloaded at the delivery address or handed to you or your representative. From that point you are responsible for insurance, security and any damage not caused by us.
8. Delivery
We deliver Australia-wide. Order processing takes 1 to 3 business days and covers payment confirmation, order review, product allocation, preparation, internal coordination and delivery scheduling. Our delivery target is 4 to 7 business days after processing. This is a typical target, not an unconditional guarantee, and it can move for the reasons set out in our Shipping & Delivery Policy.
The standard checkout delivery charge is AUD 745 per unit, including GST, where the delivery address is within our standard service area. Remote, restricted-access, oversize or multi-unit deliveries may require confirmation through quotation before dispatch. Where that applies, your order will show “Delivery requires confirmation” and we will contact you before dispatch.
Delivery equipment includes tilt trays, side loaders, Hiab and crane trucks, flatbeds and semi trailers. In some cases your own crane or forklift may be used to unload. We choose the equipment based on the unit, the address and the site information you provide.
Sunday and public holiday delivery is not part of our standard service. It may be available by prior arrangement, subject to availability, for an additional charge.
9. Site access and your responsibilities
You must make sure the delivery site is ready before the scheduled delivery. This means firm, level ground that can carry a heavy vehicle and the unit, clear access for a heavy vehicle, enough turning room, adequate gate width, no low overhead lines or trees on the approach or at the placement spot, and no soft, boggy or unstable ground. Our Delivery Site Access Guide gives typical clearance guidance.
You must give us accurate site information when ordering, including any access limits, and have a person available at the site to receive the unit. Our driver may refuse to enter or unload where they judge the site unsafe or inaccessible. If a delivery fails because the site is inaccessible, unsafe or unattended, a re-delivery or futile trip charge applies. That charge is quoted to you before the delivery is rebooked.
You are responsible for any permits, council approvals or landowner consents needed to place the unit on the site, and for identifying underground services before placement.
10. Delivery inspection
You or your representative should inspect the unit at delivery and note any visible damage on the delivery docket before the driver leaves. Photos taken at delivery help us resolve any issue quickly. A signed docket with no noted damage is evidence that the unit arrived in the condition described, but it does not affect your rights under the Australian Consumer Law for defects that were not reasonably visible at delivery.
11. Delays and events outside our control
Delivery timeframes can be affected by extreme weather, cyclones, flooding, bushfires, road closures, transport restrictions, driver shortages, carrier scheduling, mechanical breakdown, terminal and port congestion, remote-route availability, industrial action, permits, oversized-load restrictions, government restrictions, customer site restrictions, unsafe ground and customer rescheduling. When we know a significant delay is likely, we will contact you with an updated timeframe.
We are not liable for delay or failure to perform caused by events beyond our reasonable control. If such an event makes delivery impossible for an extended period, either party may cancel the affected order and we will refund any amount paid for goods not delivered. This clause does not limit any consumer guarantee that applies to you.
12. Cancellations
You may cancel an order for standard stock products before the unit is dispatched by emailing sales@aadlogisitcsau.com with your order number. If we have already incurred transport, preparation or handling costs, we may deduct those reasonable costs from your refund and will explain the deduction. Once a unit has been dispatched, a cancellation is treated as a change-of-mind return under our Returns & Refunds Policy.
Custom, modified and made-to-order units cannot be cancelled once work has begun, except as set out in section 15.
13. Returns summary
We offer a voluntary change-of-mind return period of 18 days from delivery for eligible products. Eligible products are new, standard, unmodified and unused units in their original condition. Used units, customised or modified units, made-to-order units and substantially modified products are not eligible for change-of-mind return. Return transport for a change-of-mind return is at your cost, and prior authorisation and inspection are required.
We do not run a general change-of-mind exchange program for size, transport, configuration or condition reasons. Full details, including how to lodge a return, are in our Returns & Refunds Policy. Nothing in this section limits your rights for faulty or misdescribed goods.
14. Warranty summary
We provide a voluntary warranty of 18 months on new products and a 6 month limited warranty on used products, starting on the delivery date. Claims are made by email with your order number, photos and a description of the issue. Remedies under the voluntary warranty are repair, replacement or refund at our discretion, subject to the exclusions in our Warranty Policy. The voluntary warranty is in addition to your rights under the Australian Consumer Law and does not limit them.
15. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
A major failure includes a situation where the goods would not have been bought by a reasonable consumer who knew about the problem, the goods are substantially unfit for their normal purpose and cannot easily be fixed, the goods do not match their description or sample, or the goods are unsafe. For a major failure you may choose a refund or replacement, or keep the goods and receive compensation for the drop in value. For a minor failure, we will repair the goods, or at our choice replace them or refund you, within a reasonable time.
Where goods are returned to us under a consumer guarantee claim, we bear the reasonable cost of return transport or inspection. We will never ask you to pay freight for a remedy that the Australian Consumer Law entitles you to. Used goods are still covered by consumer guarantees, but acceptable quality takes into account the age, price and disclosed condition of the unit.
16. Custom, modified and made-to-order units
Custom, modified and made-to-order units are built or altered to your specification. For these orders we may require a deposit as stated on the quotation. Work begins only after the deposit is received and the specification is confirmed in writing. The balance is due before dispatch.
Once work has begun, the deposit covers materials, labour and components committed to your order and is not refundable for change of mind. If you cancel after work has begun, we may retain the deposit and charge for additional work completed to that point, up to the order value. If we cannot complete a custom order for reasons within our control, we refund all amounts paid. Consumer guarantees apply to custom units in the same way as to standard products.
Specification changes after confirmation may change the price and lead time. We will confirm any change in writing before proceeding.
17. Liability
To the extent permitted by law, and subject to section 15, our total liability to you in connection with an order is limited to the amount you paid for that order. Where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee for goods that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of replacement or repair.
We are not liable for indirect or consequential loss, loss of profit, loss of business or loss of use, except where such loss is reasonably foreseeable and recoverable under the Australian Consumer Law. We are not responsible for damage caused by your failure to prepare the site, by placement on unsuitable ground, or by modifications made after delivery. Nothing in this section limits liability that cannot be limited by law.
18. Your obligations and acceptable use
You must give us accurate contact, delivery and site information, hold any approvals needed to place the unit, and use the website lawfully. Our Acceptable Website Use page sets out what you must not do, including scraping, fraudulent orders and uploading unlawful content. We may suspend access or refuse orders where these obligations are breached.
19. Privacy
We collect and handle personal information in line with the Australian Privacy Principles. Our Privacy Policy explains what we collect, why, who we share it with and how you can access or correct it. By ordering, you agree that we may share your delivery details with freight carriers and other providers needed to fulfil your order.
20. Intellectual property
All content on the website, including the AAD Logistics logo, text, photography we produced, diagrams, design and technical illustrations, is owned by AAD Logistics Pty Ltd or used under licence. You may view and print pages for your own use in dealing with us. You may not copy, republish or use our content commercially without written permission. Third-party trademarks, standards and licensed images remain the property of their owners. See our Intellectual Property Policy.
21. Notices and communication
We send order confirmations, tax invoices and delivery updates to the email address on your order. You are responsible for keeping that address current and checking it, including spam folders. Notices to us should be sent to sales@aadlogisitcsau.com and should quote your order number.
22. General
If any part of these terms is invalid or unenforceable, the rest continues in force. Our failure to enforce a term is not a waiver of it. You may not assign your order without our written consent. These terms, together with the order confirmation, the quotation where applicable, and the policies referred to above, form the entire agreement between us for the order.
We may update these terms from time to time. The version in force when your order is confirmed applies to that order.
23. Governing law
These terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them. This clause does not prevent you from making a complaint to a consumer protection body or a tribunal in your own state or territory.
